General Terms and Conditions (Terms)

Draft translation, pending legal review. The German version is the legally binding original; in case of discrepancy, the German text governs.

§ 1 Scope of application

These General Terms and Conditions ("Terms") govern the use of the Check-Job web application (the "Service") between the operator (the "Provider") and the user. They apply to users resident in Switzerland, Germany, and Austria. By registering for and using the Service, the user accepts these Terms.

§ 2 Services provided by the Provider

The Provider operates a web-based platform that allows users to have their résumé (CV) analyzed against a job description. The analysis is performed using artificial intelligence and includes:

  • A match score (percentage of fit)
  • Identification of strengths and gaps
  • Optimization tips for the résumé
  • Optional (Pro feature): generation of a cover letter
  • Optional (Pro feature): AI career-advisor chat

The results of the analysis do not constitute legal advice, a guarantee of employment, or a binding assessment. Responsibility for the accuracy of the data entered lies with the user.

§ 3 Registration and account

Using the Service requires registration. The user must provide truthful information when registering. The account is not transferable. The user is solely responsible for keeping their login credentials confidential.

§ 4 Use – Free and Pro

4.1 Free use

Every user is entitled to two (2) free CV analyses. These are limited to the basic features (match score, strengths, gaps, tips).

4.2 Pro use

With a Pro subscription, the user receives unlimited analyses as well as access to the advanced features (AI career advisor, cover letter generator). Pro use is subject to a fee; the applicable prices are disclosed before the subscription is concluded. The governing contract currency is the Swiss franc (CHF); amounts shown on the website in other currencies (e.g. EUR, USD, GBP) are for reference only and use the same numeric value as the CHF price.

§ 5 User obligations

The user undertakes:

  • Not to upload unlawful, offensive, or misleading content
  • Not to use third parties' documents without their consent
  • Not to misuse or disrupt the Service
  • Not to use automated scripts or bots to access the Service

§ 6 Availability and maintenance

The Provider endeavors to operate the Service with high availability. There is no entitlement to uninterrupted availability. Maintenance work, outages, and extraordinary events may cause interruptions. The Provider reserves the right to further develop the Service or adjust its features at any time.

§ 7 Liability

The Provider is liable in accordance with statutory provisions for intent and gross negligence. For slight negligence, the Provider is liable only for breach of material contractual obligations and only for typical, foreseeable damages.

The AI-generated analyses are suggestions and recommendations. Liability for the accuracy, completeness, or usability of the results is excluded. The user reviews the results at their own responsibility.

§ 8 Grant of usage rights

The user grants the Provider the right to process the uploaded documents and entered text for the purpose of carrying out the requested analysis and to forward them to affiliated AI service providers. No further use beyond this takes place.

§ 9 Termination and deletion

The user may delete their account at any time. Upon deletion, all stored data (analyses, uploaded documents) is irrevocably removed. A Pro subscription can be terminated monthly; the right to extraordinary termination remains reserved.

§ 10 Right of withdrawal (DE/AT)

Consumers in Germany and Austria have a statutory right of withdrawal pursuant to §§ 355 et seq. of the German Civil Code (BGB) and § 11 of the Austrian Consumer Protection Act (KSchG), respectively. The right of withdrawal expires for contracts for digital content where the user has expressly consented to performance beginning before the end of the withdrawal period and thereby loses their right of withdrawal.

§ 11 Governing law and jurisdiction

Switzerland: Swiss law (Swiss Code of Obligations) applies. The place of jurisdiction is [Ort, Schweiz].
Germany: German law applies. The place of jurisdiction is [Ort, Deutschland].
Austria: Austrian law applies. The place of jurisdiction is [Ort, Österreich].

The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) are expressly excluded.

§ 12 Changes to these Terms

The Provider reserves the right to amend these Terms at any time. The user will be informed of material changes by email. If no objection is raised, the new Terms are deemed accepted.

§ 13 Severability clause

Should individual provisions of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a valid arrangement that comes closest to the economic purpose intended shall apply.
